FCRA consumer rights

Assistance for victims of human trafficking

Federal law gives victims of human trafficking the right to ask consumer reporting agencies to block adverse information that resulted from trafficking. American Tenant Screen, Inc. dba VerifyProtect ("ATS/VerifyProtect") is committed to helping consumers exercise these rights under the Fair Credit Reporting Act (FCRA) and Regulation V.

If adverse information in a tenant-screening or employment background report resulted from human trafficking, you may submit a request to have that information blocked from future consumer reports.

What you need to submit

Please provide the following four items. If something is missing or we cannot reasonably verify it, we will contact you using your preferred contact method.

1. Proof of your identity

Please provide appropriate proof of identity. Examples may include:

  • Driver's license
  • State-issued identification card
  • Passport
  • Social Security card
  • Utility or service bill
  • Other government-issued identification

If you do not have one of these forms of identification, call us at 800-888-1287 so we can work with you to confirm your identity another way.

2. Victim determination documentation

A document showing that you are a victim of human trafficking, such as a determination from a federal, state, tribal or local government agency or court, or a signed statement from an authorized representative of one of the organizations recognized for this purpose under Regulation V.

We will not ask you to prove that the trafficking occurred beyond the victim-determination documentation required by law.

3. Identification of the adverse information to block

Tell us which items on the report resulted from trafficking. You may list more than one item. Report or case details — such as a report number, the employer or property manager, dates, or jurisdiction — help us locate the information, but are optional.

4. Your preferred contact method

Tell us whether you would like us to contact you by email or by postal mail, and include that address. We will use only the method you choose for communications about your submission.

How to submit your request

A secure online submission form is being prepared. In the meantime, please send your request by fax or mail.

What happens after we receive your request

  1. 1

Within 4 business days after we receive your submission, we will block the reporting of the adverse information you identified while we review the request.

  2. 2

If additional information is necessary to complete your submission, we will contact you within 5 business days and attempt to resolve the missing information. We may request additional information only if we cannot reasonably confirm identity, do not have acceptable victim-determination documentation, or cannot identify the adverse information to be blocked.

  3. 3

We will make a final determination no later than 25 business days after receiving your submission.

  4. 4

Within 5 business days after the final determination, we will send notice using your preferred contact method. The notice will state that the review is complete, explain the outcome, provide a revised consumer report at no cost if applicable, describe the procedure used, explain how to contact us to appeal or correct a deficient submission, and provide information about submitting a complaint to the Consumer Financial Protection Bureau.

We will not ask you to prove that the trafficking occurred beyond the victim-determination documentation required by law, and we will not challenge whether the adverse information you identified resulted from trafficking.
